A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. Curry & Sons Construction, LLC, at the worksite located near intersection of Congress Avenue & E. Sharon Road, Cincinnati, OH: Employees were working in an excavation with no safe means of egress that measured 7-1 in depth, 9' in width, and greater than 25' in length that had no suitable means of access/egress located within 25' of the work area within the excavation.

29 CFR 1926.651(h)(1): Employees shall not work in excavations in which there is accumulated water, or in excavations in which water is accumulating, unless adequate precautions have been taken to protect employees against the hazards posed by water accumulation. The precautions necessary to protect employees adequately vary with each situation, but could include special support or shield systems to protect from cave-ins, water removal to control the level of accumulating water, or use of a safety harness and lifeline. Curry & Sons Construction, LLC, at the worksite located near intersection of Congress Avenue & E. Sharon Road, Cincinnati, OH: Employees were working in an excavation that was measured 7'-1" in depth, 9' in width, and greater than 25' in length in which water was accumulating and that no adequate protected system was installed or water removing system, or safety harness and lifeline used to protect employees from cave-in hazards. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
