29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.    a) On June 15, 2016 at 463 Claxton Glen Ct. in Washington Township OH the employer did not ensure that employees working in the trenches were thoroughly trained in the hazards associated with trenching and excavating and the regulations applicable to such operations.

29 CFR 1926.651(j)(2): Employees shall be protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.    a)  On 15 June, 2016 the trench at Claxton Glenn did not have the spoil pile retained 2 feet back from the edge for approximately 60.

29 CFR 1926.651(k)(2): Where the competent person finds evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees shall be removed from the hazardous area until the necessary precautions have been taken to ensure their safety.    a)  On June 15, 2016, employees were not removed from cave-in hazards in that employees were instructed to enter the 60 feet long and 12 feet deep trench to remove the fill dirt near the house located at 463 Claxton Glenn Ct after a cave-in occurred.      b) On June 15, 2016, at 463 Claxton Glenn Ct., there was no precaution taken before the employees were instructed to enter the 60 feet long - 12 feet deep trench near the driveway to complete the installation of the sewer pipe.  The trench collapsed trapping an employee under over 8 feet of fill dirt.

29 CFR 1926.652(a)(1): Each employee in an excavation that was more than 5 feet deep and not in stable rock shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:  This employer does not provide adequate cave in protection for employees working in excavations that are more than five feet deep and not in stable rock.  This failure to provide adequate protection was recently demonstrated on June, 15 2016.  a) On June 15, 2016 employees working in the trench near the house located at 463 Claxton Glenn Ct. in Washington Township Ohio were not adequately protected against cave-ins in that the walls of the trench were not properly sloped, shored, benched or otherwise adequately protected against a collapse.  The trench was approximately 60' long and approximately 12 feet deep.  Following the cave-in employees were instructed to enter the trench to dig out the cave-in.    b) On June 15, 2016 employees working in the trench near the driveway located at 463 Claxton Glenn Ct. in Washington Township Ohio were not adequately protected against cave-ins in that the walls of the trench were not properly sloped, shored, benched or otherwise adequately protected against a collapse.  The trench approximately 60 feet long and approximately 12 feet deep collapsed while an employee was in the trench.
