29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: (a) Bomar Painting, Inc. @ 2550 S University Blvd, Denver CO 80210: On or about June 19th 2016, the exposing and controlling employer did not ensure that employees were using fall protection while working on the 8th floor balcony of the Post House Apartments. Employees were painting the ceiling above the balcony by standing on the perimeter railing without personal fall arrest systems. This condition exposed employees to a fall hazard of approximately 80 feet.

29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii): (a) Bomar Painting, Inc @ 2550 S University Blvd, Denver CO 80210: On June 19th 2016, the exposing and controlling employer did not install a fall protection system for employees who were hired to paint the exterior balconies of a 10-story apartment building. This condition exposed employees to a fall hazard up to 80 feet or greater. Abatement note: 29 CFR 1926.502(a)(2) include the following requirements for fall protection training: 1926.503(a)(2)(I): The nature of fall hazards in the work area; 1926.503(a)(2)(ii): The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; 1926.503(a)(2)(iii): The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; 1926.503(a)(2)(iv): The role of each employee in the safety monitoring system when this system is used; 1926.503(a)(2)(v): The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; 1926.503(a)(2)(vi): The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and 1926.503(a)(2)(vii): The role of employees in fall protection plans; and 1926.503(a)(2)(viii): The standards contained in this subpart.
