29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (Construction Reference 1926.103)  a.  Voecks Masonry, LLC. project site located at 7325 Purdy Parkway Appleton, WI 54913:  On and before June 20, 2016, Voecks Masonry, LLC. did not have a written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures.  All provisions of 29CFR 1910.134(c) through (o) must be covered in a respiratory protection program.  Key elements include, but are not limited to the following:          1.  Selection of respirators for employees.         2.  Medical evaluations of employees.         3.  Fit testing.         4.  Training and information.         5.  Recordkeeping.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (Construction Reference 1926.103)  a.  On and before June 20, 2016, Voecks Masonry, LLC. did not provide employees medical evaluations prior to requiring them to wear a respirator when cutting bricks at the worksite.   Note:  The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.

On and before June 20, 2016, the employer did not perform qualitative or quantitative fit tests prior to requiring  employees to wear tight-fitting facepiece respirators while dry cutting bricks.
