OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by or crushing hazard when operating a forklift without a serviceable seat belt and training on safe operations: a) On or about June 21, 2016 and at times prior thereto: the latch plate was missing from the Electric Baker Linde powered industrial truck (forklift) with an approximate 3,500 pound capacity, model unknown. The forklift was utilized to transport ice and food products on the worksite. b) On or about June 21, 2016 and at times prior thereto: the seat belt was missing from the Electric Toyota powered industrial truck (forklift) with an approximate 3,000 pound capacity, model unknown. The forklift was utilized to transport and tow trailers. Note: Abatement certification IS required for this item.

Employees operate electric forklifts on site while handling loads of ice and food materials. NOTE: Abatement certification is required for this item.
