29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  At the residential construction site located at 157th Terrace, between 11626 and 11627 in Overland Park, Kansas:  Employees engaged in framing activities were exposed to dermal, ingestion, and inhalation hazards from exposure to hazardous chemicals.  The employer had not developed or implemented a written hazard communication program to ensure that employees were aware of the hazards associated with the chemicals with which they work.  Hazardous chemicals used at the site included but were not limited to Grip Rite Subfloor Construction Adhesive.

A copy of the required safety data sheet for Grip Rite Subfloor Construction Adhesive was not maintained at the residential construction site exposing employees to dermatitis and eye injury.

Employees had not been provided with training or information regarding the hazardous chemicals with which they work.  Hazardous chemicals such as Grip Rite Subfloor Construction Adhesive were used at the residential construction site.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  At the residential construction site located at 157th Terrace, between 11626 and 11627 in Overland Park, Kansas:  Employees engaged in residential framing activities were exposed to fall hazards of approximately 13 feet from the upper level of the building to the ground below while accessing and exiting the structure in that the portable ladder did not extend at least 3 feet above the upper landing and was not secured to the structure.
