29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) New residential construction located on Lot #36, Upper roof: On or about June 23, 2016, and at times prior, the employer exposed employees to fall hazards of 29-feet, 10-inches on a 4/12 pitched roof, in that a fall protection system was not provided to employees installing plywood sheathing. (b) New residential construction located on Lot #36, Lower roof: On or about June 23, 2016, and at times prior, the employer exposed employees to fall hazards of 15-feet, 4-inches on a 6/12 pitched roof, in that a fall protection system was not provided to employees installing plywood sheathing.

29 CFR 1926.1053(a)(2): Ladder rungs, cleats, and steps were not parallel, level, and uniformly spaced when the ladder was in position for use: (a) New residential construction located on Lot #36, First floor foyer: On or about June 23, 2016, and at times prior, the employer exposed employees to fall hazards of 10-feet, 5-inches from the second floor landing, in that a make shift ladder with cleats was used and the wood cleats nailed to the wall were not level or uniformly spread which created a fall hazard while ascending and descending from each level.
