29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that:    a) 4th and Union St. Wilmington, DE- On or about June 22,2016, the employer failed to protect the employees inside an excavation approximately 27 ft. long, 44 ft. wide and 7 ft. deep, at its deepest point, from cave-in by an adequate protective system.  The excavation was on previously disturbed type B soil and had 90 degree walls.      Note: Pursuant to 29 CFR 1903.19, the employer must submit abatement certification and documentation, required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written documentation.
