29 CFR 1926.62(d)(1)(i): Each employer who had a workplace or operation covered by 29 CFR 1926.62 did not initially determine if any employee was exposed to lead at or above the action level of 30 micrograms per cubic meter of air (30 mg/m3) calculated as an 8-hour time-weighted average (TWA):  On or about June 24, 2016 at a worksite located at 105 Washington St., Oshkosh, WI 54901, RH Design Build LLC did not initially determine if any employee was exposed to lead at or above the action level when employees were conducting demolition of drywall which had paint coatings containing lead.

29 CFR 1926.62(l)(2): Employees were not trained in the following: contents of this standard and its appendices; the purpose, proper selection, fitting, use, and limitations of respirators; the purpose and a description of the medical surveillance program:  On or about June 24, 2016 at a worksite located at 105 Washington St., Oshkosh, WI 54901, RH Design Build LLC did not train employees conducting manual demolition of drywall with paint coatings containing lead on the contents of this standard and it appendices, respirator use and limitations, and the purpose and a description of the medical surveillance/removal program.   All provisions of 29 CFR 1926.26(l)(2)(i) through (vii) must be covered in a lead training program. Key elements include but are not limited to the following.  1)  Contents of lead in construction standard and its appendices 2)  Operations causing lead exposure 3)  Uses and limitations of respirators 4)  Medical surveillance and removal program 5)  Engineering and work practice controls

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  On June 24, 2016 at a worksite located at 105 Washington St., Oshkosh, WI 54901, RH Design Build LLC did not develop, implement, and/or maintain at the workplace a written hazard communication program when employees were working with hazardous chemicals such as, but not limited to, enamel latex paint.  All provisions of 29 CFR 1910.1200(e) through (h) must be covered in a hazard communication program. Key elements include, but are not limited to, the following:  1)  List of hazardous chemicals onsite 2)  Complete collection of SDS 3)  Labeling of containers 4)  Employee information and training
