29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: (a) On or about June 25, 2016, Daniel Mendoza did not ensure that its employees were protected from falls while working at heights greater than 6 feet. Employees of Daniel Mendoza were exposed to fall hazards in excess of 12 feet while engaged in roofing activities on the roof of a residential building with no fall protection in place. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) On or about June 25, 2016, Daniel Mendoza did not ensure that portable ladders extended at least 3 feet above the landing surface. Employees of Daniel Mendoza were exposed to fall hazards in excess of 12 feet while engaged in roofing activities on the roof of a residential building where the ladder to access the upper roof of the building did not extend at least 3 feet past the landing surface. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
