29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: North side of roadway; On or about June 28, 2015, employees were exposed to struck-by hazards while in an excavation greater than 5 feet in depth by 6 feet in width by 11 feet in length, when locating a water main line in an excavation with a spoil pile located less than 2 feet from the excavation wall. The Southwest Backhoe & Utility Services, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(j)(2), which was contained in OSHA inspection number 976384, citation number 1, item number 1 and was affirmed as a final order on September 10, 2014, with respect to a workplace located at 17903 La Cantera Parkway, San Antonio, TX 78257.
