29 CFR 1910.1025(j)(1)(iii): Required medical surveillance for lead was not provided without cost to employee: a. Establishment - On or about June 21, 2016, Employees, Range Safety Officers, were exposed to lead in excess of the permissible exposure limit. Lead exposures occurred while employees were observing shooters on the range and while cleaning the range. Medical examinations and blood lead and zinc protoporphyrin testing received by employees was not provide without costs to the employees. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photograph or video evidence of abatement or other written records.

29 CFR 1910.1025(k)(2)(i): An employee removed from exposure to lead, or otherwise limited pursuant to 29 CFR 1910.1025 was not provided with medical removal protection benefits: a. Establishment/Firing Range - On or about May 24, 2016, The employer discontinued Medical Removal Benefits for an employee working as Range Safety officer who had been removed for Medical Removal Protection in January 2016, and who had blood leads still in excess of 40 ug/dl. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photograph or video evidence of abatement or other written records.
