29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:     The employer is failing to protect employees from struck by hazards associated with operating company modified forklift. The most recent occurrence of this was evident during the inspection at the facility located at 1 Mill Road, Pender, NE 68047, where the employer had employees operating forklifts that have had the forks modified.  Instances include but may not be limited to:     i.  Employees operating the Yale model GLP040AFNVAE084,serial number A810N0326OU where the employer has drilled out holes in the tips of the forks without having consulted with the manufacturer to validate the modification will not affect operational performance.    ii. Employees operating the number 8 stand up forklift, model RC2500, serial number 1108 where the employer has fabricated brackets installed on the tips of the forks without having consulted with the manufacturer to validate the modification will not affect the operational performance.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:     The employer is failing to protect employees from amputation hazards associated with operating inadequately guarded machines.  The most recent occurrence of this was evident in a work place incident at the facility located at 1 Mill Road, Pender, NE 68047, where the employer had an inexperienced employee setting up and operating the inadequately guarded number 41 Hobb Machine; the result was an amputation of a portion of the employees finger.

29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed:   The employer is failing to protect employees from electrical and amputation hazards associated with performing maintenance on equipment with written specific procedures that have not been reviewed at least annually.  The most occurrence of this was evident during the inspection of the facility located at 1 Mill Road, Pender, NE 68047, where the employer has employees performing maintenance on equipment that require the implementation of lockout and/or tag out as means of preventing unintentional energizing without having conducted the annual periodic review of the written specific procedures.  Instances of exposure include but are not limited to:   i.  Employees using written control procedures dated 5/22/15 as the guidelines for locking out the hazardous energy for the Hob 41-4.   ii. Employees using written control procedures written on 5/22/15 as the guidelines for locking out the hazardous energy for the Hob 42-4.
