OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to immersion drowning hazards due to the lack of a farm vehicle barrier guard on a push-off platform of a manure slurry pit: a) M W Smith Farms & 851 Meadow Grove Road - An employee operating a New Holland L 170 skid loader used for pushing manure off the push-off platform and laying bedding with the side-chucker attachment was exposed to an immersion drowning hazard. The edge of the manure pit was not provided with a guard beam, on or about June 28th, 2016. No abatement certification or documentation required.
