29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.   a) On or about 07/01/16, in old building under renovation at 197 Virginia Street, Buffalo, NY:  Employees were exposed to a potential fall ranging from approx. 15 to 30 ft. through window openings  while working on the second, third, and fourth floors. The bottom edge of the window openings were typically 27 inches or less above the floor, and there were 4 such window openings on the second floor, 13 such window openings on the third floor, and 5 such window openings on the fourth floor. Each window opening lacked a top rail. No other fall protection system was used to protect employees from falling through the window openings.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge:   a) On or about 07/01/16, on the stairway from the fourth floor to the third floor of an old building under renovation at 197 Virginia Street, Buffalo, NY:  Employee was exposed to a potential fall down/off the stairway which had approx.  12 risers and was not enclosed on the left side descending.  No stair rail system (that includes an intermediate component, screen, or mesh) was present on this side.  b) On or about 07/01/16, on the stairway from the third floor to the second floor of an old building under renovation at 197 Virginia Street, Buffalo, NY:  Employee was exposed to a potential fall down/off the stairway which had approx.  12 risers and was not enclosed on the left side descending.  No stair rail system (that includes an intermediate component, screen, or mesh) was present on this side.     NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1052(c)(12): Unprotected sides and edges of stairway landings were not provided with guardrail systems that meet the criteria contained in Subpart M of 29 CFR 1926:   a) On or about 07/01/16, on the fourth floor of an old building under renovation at 197 Virginia Street, Buffalo, NY:  A guardrail system was installed along the north side and east end of a stairway opening to prevent employees from falling up to 10 ft. onto the stairs or floor below. The guardrail system was deficient in that the top rails were only 29.25 inches above the floor, and there were no midrails installed.    NO ABATEMENT CERTIFICATION REQUIRED
