29 CFR 1960.8(a): The Agency head did not furnish employment and a place of employment to each employee that were free from recognized hazards that caused or were likely to cause death or serious physical harm in that employees were exposed to the hazards of burns, smoke inhalation and death from fire related causes: (a) Division C, Cedar Fire, Fort Apache Agency: The Agency Firefighters had to deploy emergency fire shelters when entrapped by a large fire whirl. Feasible and useful methods to abate the hazard is to follow the: Incident Response Pocket Guide (PMS-461) - Risk Management The Standard Fire Order to "Base all actions on current and expected behavior of the fire." The Watchout Situation "Terrain and fuels make escape to safety zone difficult." And to familiarize firefighters with the conditions which may cause dangerous fire whirls to develop and encourage timely decision making regarding the use of identified escape routes.

THE U.S. DEPARTMENT OF INTERIOR, BUREAU OF INDIAN AFFAIRS - FORT APACHE AGENCY WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCUPATIONAL SAFETY AND HEALTH STANDARD, WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 315796805, CITATION 01, ITEM NUMBER 003 AND WAS AFFIRMED AS A FINAL ORDER ON JANUARY 31, 2012, WITH RESPECT TO A WORKPLACE LOCATED AT BUREAU OF INDIAN AFFAIRS - FORT APACHE FIRE MANAGEMENT CENTER, N 33 DEGREES 36' 105"/W 109 DEGREES 37' 409" APPROXIMATELY 1/2 MILE NORTH OF BLACK RIVER, ARIZONA 85491.
