29 CFR 1910.132(a): Personal protective equipment for eyes, face, head and extremities, protective clothing, respiratory devices, and protective shields and barriers were not provided and used when necessary by reason of hazards encountered in a manner capable of causing injury or impairment in the function of any part of the body:    a) On or about July 3, 2016, at the above located workplace, employees were required to work with and around fireworks (5 and 6 inch fireworks display mortar shells). The employer had not provided and required employees to use personal protective equipment (PPE) including, but not limited to, safety glasses, safety shields, protective barriers and flame resistant clothing and gloves. The lack of proper personal protective equipment exposed the employees' eyes, face, torsos, arms and hands to the hazards associated with a premature ignition of the commercial grade fireworks.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment (PPE) and when the hazards were likely to be present, the employer did not select, and have each affected employee use, the types of PPE that would protect the employees from the hazards identified:                a) On or about July 3, 2016, at the above located workplace, employees were required to work with and around fireworks (5 and 6 inch fireworks display mortar shells). The employer had not performed an effective assessment of the workplace to determine if hazards were likely to be present during setup which necessitated the use of personal protective equipment (PPE), and when hazards were likely to be present, the employer did not select, and have each affected employee use, the types of PPE that would protect the employees.  Employees were thereby exposed to the hazards associated with the premature and unexpected ignition of commercial grade fireworks.

29 CFR 1910.1200(e)(1): Employers did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met:             a) On or about July 3, 2016, at the above located workplace, employees required to work with 5 inch "Extremely Dangerous" fireworks manufactured by BonBridge Fireworks and other professional grade fireworks. The employer did not develop and implement a written hazard communication program. Employees were thereby exposed to the hazards associated with handling and inhalation of hazardous chemicals.

29 CFR 1910.1200(h):  Employees were not provided information and training as specified in 29 CFR 1910.1200(h)(1) and (2) on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard was introduced into their work area:                   a) On or about July 3, 2016, at the above located workplace, employees were required to work with 5 inch "Extremely Dangerous" fireworks manufactured by BonBridge Fireworks and other professional grade fireworks. The employer did not provide employees information and training as specified in 29 CFR 1910.1200(h)(1) and (2) on hazardous chemicals in their work area. Employees were thereby exposed to the hazards associated with handling and inhalation of hazardous chemicals.
