OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed a caught by hazard:      a. On or about July 13, 2016, at Bay #9 of the above addressed jobsite, employees were exposed to a caught by hazard while working with a press brake (i.e. Chicago, no other information available) that did not have its pedal guarded from unintended operation.      b. On or about July 13, 2016, at Bay #9 of the above addressed jobsite, employees were exposed to a caught by hazard while working with a shear (i.e. Niagara, NR I-10) that did not have its pedals guarded from unintended operation.

29 CFR 1910.101(b): The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tankcars, or motor vehicle cargo tanks were not in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in CFR 1910.6: (Section 3.3.3: Do not store cylinders near elevators or gangways, or in locations where heavy moving objects may strike or fall on them.  Where caps are provided for valve protection, such caps should be kept on cylinders in storage):    On or about July 6, 2016 at the above addressed jobsite, employees were exposed to struck by, fire and explosion hazards as evidenced by, among other conditions:    a.  At Bay #2, a compressed gas cylinder (i.e. Argon) was not secured while placed in an area where it could be knocked over.  b.  At Bay #3, six compressed gas cylinders (i.e. Argon) were not secured while placed in an area where it could be knocked over, and two of them lacked a valve protection cap.    c.  At Bay #3, two compressed gas cylinders (i.e. Argon 75%, 25% Carbon Dioxide) were not secured while placed in an area where it could be knocked over, and one of them lacked a valve protection cap.
