29 CFR 1910.1200(e)(1): The employer did not develop, implement and maintain at the workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g) and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met:    a)  At the facility, on or about July 7, 2016 - A written hazard communication program was not developed, implemented, and maintained at the workplace.  Employees use PDC containing Solvent Naphtha, causing dermatitis, when paving.

29 CFR 1910.1200(f)(5): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged, or marked with the identity and appropriate hazard warnings regarding the chemicals contained therein:  a)  At the facility, on or about July 7, 2016 - Totes were not labeled, tagged, or marked with the correct identity and appropriate warnings regarding the chemicals contained in the totes.  Employees use totes of PDC containing Solvent Naphtha, causing dermatitis, when conducting paving operations.

29 CFR 1910.1200(g)(8):   The employer did not maintain, in the workplace, copies of the required safety data sheets for each hazardous chemical  a)  At the facility, on or about July 7, 2016 - Copies of the safety data sheets were not maintained at the workplace for each hazardous chemicals. Employees use SealMaster CrackMaster Supreme containing Asphalt, causing burns to the skin, during paving operations.

29 CFR 1910.1200(h)(3)(iv):   The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information:  a)  At the facility, on or about July 7, 2016 -  Employees were not provided with training in regards to the new labeling element and safety data sheets. Employees use PDC containing Solvent Naphtha, causing dermatitis, when conducting paving operations.
