29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Cross braces were used as a means of access.  a. At the site, employees were exposed to a 13 foot fall hazard, in that, there was no scaffold ladder provided to access/egress the upper levels of the scaffold platform, on or about 07/07/2016.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  a. At the site, employees were exposed to a 13 foot fall hazard, in that, there was no top or mid rails used while working from the scaffold, on or about 07/07/2016.

29 CFR 1926.451(h)(2)(ii): A toeboard was not erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below: Note:  This requirement does not apply to float (ship) scaffolds where an edging of 3/4 inch x 1 1/2 inch (2 x 4 cm) wood or equivalent was used in lieu of toe boards.  a. At the site, employees were exposed to a struck by hazard, in that, no toe boards were present while employees were working with tools from an elevated position 07/07/2016.
