29 CFR 1926.451(c)(2)(v): The employer used forklifts to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied:. Note: Preamble to Subpart L promulgated new paragraph (c)(2)(iv) & (v) in final rule to provide guidance. On or about July 7, 2016, the employer did not ensure a platform used to elevate an employee to an upper level was securely attached to the forks of the rough terrain forklift. The employee was exposed to a fall hazard.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. On or about July 7, 2016 and at times prior thereto, the employer allowed an employee to ride on a pallet placed on the forks of a rough terrain forklift without fall protection, exposing the employee to a fall hazard.
