29 CFR 1910.147(c)(1): The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.    On or about 14 July 2016, the employer did not establish an energy control (lockout/tagout) program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance, the machine would be isolated and rendered inoperable. Employees exposed to caught-in hazards likely to result in crushing injuries and/or amputation from unexpected energizing, start up or release of stored energy from equipment, including saws and a baler were not required to use lockout/tagout.    Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:    On or about 14 July 2016, the employer did not develop, implement, and maintain a written hazard communication program at the workplace which described how the criteria specified in 1910.1200(f), (g), and (h) will be met for employees exposed to hazardous chemicals, including Mulch Magic Cherry Brown, propane, and cleaning chemicals.    Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1910.38(a): Application. An employer must have an emergency action plan whenever an OSHA standard in this part requires one. The requirements in this section apply to each such emergency action plan.  On or about 14 July 2016, the employer failed to establish a written emergency evacuation plan for employees expected to evacuate in the event of a fire or other emergency. This exposed employees to fire hazards in case of such an emergency.  Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
