29 CFR 1926.52(d)(1): Sound levels exceeded the values in Table D-2 of subpart D of 1926 and a continuing, effective hearing conservation program was not administered: An effective hearing conservation program which includes but is not limited to monitoring of employees noise exposure, baseline and annual audiometric testing of employees was not instituted by Bulley & Andrews Concrete Restoration, when employee exposure to noise exceeded Table D-2: a. On or about July 12, 2016, at the above addressed jobsite, an employee was operating a jackhammer during a sidewalk renovation project. This employee was exposed to continuous noise levels at 333% of the allowable 8-hour time weighted average sound level (90dBA). The equivalent dBA level of 333% is approximately 98.7 dBA thereby exposing the employee to noise hazards. b. On or about July 12, 2016, at the above addressed jobsite, an employee was operating a jackhammer during a sidewalk renovation project. This employee was exposed to continuous noise levels at 418% of the allowable 8-hour time weighted average sound level (90dBA). The equivalent dBA level of 418% is approximately 100.31 dBA thereby exposing the employee to noise hazards.
