29 CFR 1910.151(b): At this establishment, the employer did not have at least one employee in the work place with current certificates in Basic First Aid and CPR. a) 7000 Millington Road, Clayton, DE - On or about July 6, 2016, the employer did not ensure at least one employee at the farm equipment shop was trained and certified in First Aid and CPR. An employee who sustained an injury on site did not receive first aid until EMS, ambulance and first responders arrived on site.

29 CFR 1910.219(e)(1): Horizontal belts which had both runs 42 inches or less from the floor level were not fully enclosed by guards conforming to the requirements specified in 29 CFR1910.219 (m) and (o): a) 7000 Millington Road, Clayton, DE - On or about July 12, 2016, the employer failed to ensure the power transmission belt on the pressure washer was fully enclosed, exposing employees to nip points created between the belt and pulley.

29 CFR 1928.57(a)(6): At the time of initial assignment and at least annually thereafter, the employer did not instruct every employee in the safe operation and servicing of all covered equipment with which he was or would be involved: a) 7000 Millington Road, Clayton, DE - On or about July 06, 2016, the employer failed to instruct every employee in the safe operation and servicing of all harvesting equipment with which he was involved. An employee, who had not received the instruction, was using a pressure washer and hose to clean a Pea Harvester when the hose became entangled in the Spinner on the front of the machine, pulling the employee's leg into the spinner, resulting in multiple leg fractures. Abatement Note: At a minimum, the employer shall instruct each employee as outlined in paragraph (a)(6)(i) through (a)(6)(v) initially and annually thereafter.
