OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to fall hazard in the workplace. a) On or about July 15, 2016 at 131 Akron Street, Lindenhurst, NY11757, the owner of Long Island Garden & Tree Services Inc. was catapulted from a bucket truck approximately 40 feet. The boom truck upper arm was being used as a crane. NOTE: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR 1910.67(c)(2)(v): A body belt was not worn and a lanyard attached to the boom or basket when working from an aerial lift: a) Worksite, Rear of 131 Akron Street, Lindenhurst, NY: the owner of Long Island Garden & Tree Services Inc. was catapulted from a bucket truck approximately 40 feet. The owner was not using fall protection; on or about 7/15/16. In addition to abatement certification, the employer is required to provide abatement documentation for this item in accordance with 29 CFR 1903.19.
