The employees were not using any form of fall protection and were thus exposed to a fall hazard of greater than 24 feet to the ground below.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. a) 103 Passaic Ave., Spring Lake, NJ: On or about July 19, 2016, two TDA General Contractor LLC employees were installing 3rd floor roof soffit fascia from a scaffold pic. The employees had not been trained to recognize hazards associated with scaffold use and the procedures to control or minimize those hazards. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
