29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection.     a) 103 Passaic Ave., Spring Lake, NJ: On or about July 19, 2016, two TDA General Contractor LLC employees were installing 3rd floor roof soffit fascia from a scaffold pic.  The employees were not using any form of fall protection and were thus exposed to a fall hazard of greater than 24 feet to the ground below.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.   a) 103 Passaic Ave., Spring Lake, NJ: On or about July 19, 2016, two TDA General Contractor LLC employees were installing 3rd floor roof soffit fascia from a scaffold pic.  The employees had not been trained to recognize hazards associated with scaffold use and the procedures to control or minimize those hazards.   NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  a) 103 Passaic Ave., Spring Lake, NJ: On or about July 19, 2016, two TDA General Contractor LLC employees were installing 3rd floor roof soffit fascia from a scaffold pic.  The rails of the ladder that employees were using did not extend at least 3 feet above the landing / walking working surface, exposing them to a fall hazard of greater than 24 feet to the ground below.

29 CFR 1926.1060(a)(1): The employer did not provide a training program for each employee using ladders as necessary, enabling each employee to recognize hazards related to ladders and the procedures to be followed to minimize these hazards.   a) 103 Passaic Ave., Spring Lake, NJ: On or about July 19, 2016, two TDA General Contractor LLC employees were installing 3rd floor roof soffit fascia from a scaffold pic.  The employees were using a portable aluminum extension ladder to access the elevated walking working surface.  The employer did not train employees to recognize hazards related to ladders and the procedures to minimize these hazards.   NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
