29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:       a) Lee Michael Industries, Inc.- On or about July 20, 2016, and at times prior thereto: Employees voluntarily utilizing 3M 7502 tight-fitting, air purifying respirators, during painting operations, had not been provided medical evaluations to determine if they were medically able to wear such respirators.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:  a) Lee Michael Industries, Inc.- On or about July 20, 2016, and at times prior thereto: Employees voluntarily utilizing 3M 7502 tight-fitting, air purifying respirators, during painting operations,  were not provided with the information contained in Appendix D to 29 CFR 1910.134.  b) Lee Michael Industries, Inc.- On or about July 20, 2016, and at times prior thereto: Employees voluntarily utilizing 3M 8210 N95,particulate respirators during painting operations,  were not provided with the information contained in Appendix D to 29 CFR 1910.134.

The employer had not developed and implemented a worksite specific written Respiratory Protection Program for voluntary users.
