29 CFR 1910.178(m)(1): Trucks shall not be driven up to anyone standing in front of a bench or other fixed object. On 20 July 2016, an employee was exposed to a struck by hazard when a forklift truck was driven up to and struck the employee who was in between the forklift and the rotational mold machine.

29 CFR 1910.178(m)(2): No person shall be allowed to stand or pass under the elevated portion of any truck, whether loaded or empty. On 20 July, 2016 employees were exposed to a struck-by hazard while passing under the elevated portion of the fork truck used to support a die while unfastening clamps that hold the die together to remove the finished product.

29 CFR 1910.178(m)(5)(iii): When the operator of an industrial truck is dismounted and within 25 ft. of the truck still in his view, the load engaging means shall be fully lowered, controls neutralized, and the brakes set to prevent movement. On July 20, 2016 employees were exposed to a struck by hazard when the operator of an industrial truck was dismounted within 25 ft. and the load engaging means were left at approximately five feet high. The forklift involved had an issue with idling high.

29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. Forklift no. 38 was not removed from service when it was identified that the throttle was idling higher than it should have been exposing employees to a struck by hazard. This forklift was involved in a fatality.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc. On 20 July, 2017 employees were exposed to a struck by hazard due the rotating parts for the McNeil machine that spins freely. The company only has a red line for protection from rotating parts.
