On July 20, 2016 employees were exposed to a struck by hazard when the operator of an industrial truck was dismounted within 25 ft. and the load engaging means were left at approximately five feet high.  The forklift involved had an issue with idling high.

Forklift no. 38 was not removed from service when it was identified that the throttle was idling higher than it should have been exposing employees to a struck by hazard.  This forklift was involved in a fatality.

One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks.
