29 CFR 1917.23(b)(1): The employer did not ensure that a properly equipped, designated person tested the atmosphere in rooms, buildings, vehicles, railcars, or other spaces that contains or had contained a hazardous atmosphere, prior to employee entry to determine whether a hazardous atmosphere existed: (a) On or about August 2, 2016, employees entered the blender/mixer for repairs without testing the atmosphere. Employees were exposed to contaminants in the air such as ammonia. (b) On or about August 16, 2016, employees entered the basement pit to perform maintenance on the conveyor. The air was monitored after entry. Employees were exposed to contaminants in the air such as ammonia, and no air monitoring was performed for ammonia.

29 CFR 1917.95(a)(1): The employer did not direct employees performing work that required special protective clothing to wear such clothing: (a) On or about July 13, 2016 in the mixing and bagging area, employees were not required to wear chemical protective gloves when mixing and bagging. Employees were exposed to Mallett 20MC, urea, lambda imidacloprid MC, diammonium phosphate, urea ammonium nitrate, and ammonium sulfate, which are damaging to the skin.
