29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulation(s) applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: POOL 411 WOLCOTT HILL ROAD WETHERSFIELD, CONNECTICUT 06109 On, or about July 12, 2016, the employer failed to instruct employees in the recognition and avoidance of unsafe conditions associated with working around and disturbing asbestos-containing and presumed asbestos-containing materials. Employees performing work in the pool ceiling, which included, but was not limited to, drilling hangers into the ceiling soffit (plaster) did not recognize the presence of asbestos. Employees disturbed soffit that was found to contain 2% chrysotile asbestos.

29 CFR 1926.1101(k)(3)(i): Before the employer permitted its own employees to perform work subject to this standard in areas containing asbestos-containing material (ACM) and presumed asbestos-containing material (PACM), the employer did not identify the presence, location and quantity of asbestos containing material and/or presumed asbestos containing material therein pursuant to 29 CFR 1926.1101(k)(1): POOL 411 WOLCOTT HILL ROAD WETHERSFIELD, CONNECTICUT 06109 On, or about July 13, 2016, the employer failed to inform employees performing work on the pool ceiling, which included, but was not limited to, drilling hangers into the ceiling soffit (plaster) about the presence of asbestos in the soffit. The soffit was later tested and found to contained 2% chrysotile asbestos.
