29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulation(s) applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: POOL 411 WOLCOTT HILL ROAD WETHERSFIELD, CONNECTICUT 06109 On, or about July 12, 2016, the employer failed to instruct employees in the recognition and avoidance of unsafe conditions associated with working around and/or disturbing asbestos-containing and presumed asbestos-containing materials. Employees performing work in the pool ceiling, which included, but was not limited to, drilling through concrete tee beams that were covered with a 3% chrysotile asbestos coating, did not recognize the presence of asbestos. Employees were hanging sheet metal in the area.

29 CFR 1926.1101(k)(3)(i): Before the employer permitted its own employees to perform work subject to this standard in areas containing asbestos-containing material (ACM) and presumed asbestos-containing material (PACM), the employer did not identify the presence, location and quantity of asbestos containing material and/or presumed asbestos containing material therein pursuant to 29 CFR 1926.1101(k)(1): POOL 411 WOLCOTT HILL ROAD WETHERSFIELD, CONNECTICUT 06109 On, or about, July 12, 2016, the employer did not identify the presence, location and quantity of asbestos containing and/or presumed asbestos containing material before the employer permitted its employees to work in the area. Employees performing work in the pool ceiling, which included, but was not limited to, drilling through concrete tee beams that were covered with a 3% chrysotile asbestos coating, were not informed of the presence of asbestos in the area. Employees were hanging sheet metal in the area.
