29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that posed a hazard by falling or rolling into excavations and protection was not provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: On or about July 22, 2016, an employee entered an excavation (trench) that was approximately 5.7 feet in depth and 4 feet in width, in order to establish where the water line was and prepare for work to be done inside. The spoil pile was approximately 1 foot or less from, and at times right along the edge of the excavation site (trench).

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: On or about July 22, 2016, at the temporary work site located at 102 US 42, Medina OH 44256, the employer failed to ensure excavation cave in protection was in place prior to an employee entering a trench that had a depth of approximately 5.7 feet and width of approximately 4 feet.
