OSH ACT of 1970 Section (5)(a)(1):     Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    The employer is failing to protect employees from severe burn injuries when exposed to molten metal. This was most recently documented on or about July 15, 2016 at 1300 Morning side Dr. Fremont, NE 68026, in the Rotocast area of the plant. The employer is failing to protect employees from serious burn injuries when slag molten metal splashed on the employees lower leg.    Among other methods, the following are feasible and acceptable methods to correction:    Engineering controls include extending the skimming tool length, installation of splash guards, or installation of an automated skimming system.      Work practice changes include workers monitoring body location (especially foot location) while skimming, or pushing the skimmer tool away from the body instead of towards the body.      Training must include both classroom and on the job training about the hazards, the controls in place, a review of applicable procedures, and demonstration of proper work practices.  Most of the training must be in a setting where the instruction can be heard and where questions can be answered.     Administrative controls include the addition of procedures that describe the hazards and proper work steps to avoid hazards, installation of warning signs, or marking or painting locations on the floor showing the proper foot location. 29 CFR 1910.132(a): Protective equipment was not maintained and or provided in a sanitary and reliable condition:    The employer is failing to protect employees from severe burn injuries.  This was most recently documented in the Rotocast area of the plant on or about July 15, 2016 at 1300 Morningside Dr., Fremont NE, 68026.  The following but not limited instances where documented:    a.  The employer failed to provide an apron, pants or leggings that covered the top of the boot to prevent molten metal and sparks from entering the boot.     b.  The employer failed to provide clothing that did not trap molten metal.    c.  The employer failed to maintain protective coveralls used by the employees in a serviceable condition in that the coveralls had holes rips and or tears that were repaired or patched.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):    The employer is failing to protect employees from severe burn injuries. This was most recently documented in the Rotocast area of the plant on or about July 15, 2016 at 1300 Morningside Dr., Fremont NE, 68026 when an employee received severe burn injuries when molten metal splashed on the left pant leg of his cotton coveralls and quickly burned through the fabric onto his shin, ankle and foot. The employer did not provide adequate protective clothing as recommended by AFS and ASTM for areas where molten metal splash hazards existed.
