29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:    a) On or about 7/26/2016, Ag Quad, 220 Tower Rd, Ithaca, NY:   On going inspections were not being performed by a competent person while employees were working inside of an excavation that was eight to ten feet weed, up to 38 feet long and up to 12 feet in depth.      Abatement certification is required for this item.

The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i):    a) On or about 7/26/2016, Ag Quad, 220 Tower Rd, Ithaca, NY:  Employees were working inside of an excavation, but outside of existing trench boxes.  The excavation had near vertical walls that were over 12 feet in depth.         Abatement certification is required for this item.
