The employer did not receive prior written approval from the manufacture before modifying the powered industrial truck, on or about July 27, 2016. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

The employer did not ensure that the loads were stable and safely arranged to prevent employees exposures to crushing hazard from tipping loads. On July, 27, 2016, an employee was fatally injured when a unstable section of a HVAC unit fell over as it was being transferred by a forklift to the loading dock. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
