29 CFR 1910.28(a)(5): Scaffolds and other devices mentioned or described in this section were not maintained in safe condition. Scaffolds were altered or moved horizontally while they were in use or occupied.  a)     On or about April 12, 2016, and at times prior, employees were exposed to fall hazards while operating a defective Skyjack model SJ-3220 scissor lift.  The employer had not implemented a preventative maintenance program to maintain the scissor lift in a safe condition.    Or in the alternative:  OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards associated with operation of a defective scissor lift:    a)     On or about April 12, 2016, and at times prior, employees were exposed to fall from height injuries while operating a defective Skyjack model SJ-3220 scissor lift.  The employer had not implemented a preventative maintenance program to maintain the scissor lift in a safe condition.

OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards from a scissor lift in that they were not adequately trained and operated it in an unsafe manner:      a)     On or about April 12, 2016, and at times prior, employees operating a Skyjack model SJ-3220 scissor lift were exposed to fall hazards due to the following:      1.     The employer did not train employees who were operating a Skyjack model SJ-3220 on safe operating methods prior to use or on how to detect defective conditions associated with this equipment.    2.    Employees operated a Skyjack model SJ-3220 scissor lift and a powered industrial truck in an unsafe manner when the platform of the scissor lift was raised with the forks of the powered industrial truck.  The scissor lift could not support the platform under its own power and as a result when the forks were removed, the platform fell to the retracted position.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours:    a)  On or about April 12, 2016, a NexGen Pharma employee was injured and required inpatient hospitalization.  NexGen Pharma did not report the incident to OSHA until July 29, 2016.    Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
