OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard.    At well site Outlar#1, employees exposed to struck-by hazards when circulating the well's high pressure hoses which were missing or not installed correctly with whip checks or other safety devices.

29 CFR 1910.106(b)(6): In locations where flammable vapors may be present, precautions were not taken to prevent ignition by eliminating or controlling sources of ignition.  Sources of ignition may include open flames, lightning, smoking, hot surfaces, frictional heat, sparks (static, electrical, and mechanical), spontaneous ignition, chemical and physical-chemical reactions, and radiant heat:       At well site Outlar #1, employees were exposed to fire and explosion hazards while performing plug and abandoned operations (utilizing a torch) where flammable gases were present.

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:    At well site Outlar #1, employees were working at the well-bore of a natural gas well during plug and abandoned operations, in which lines were under pressure, and were exposed to the hazard of burns from flash fires without the protections of fire retardant clothing (FRC's).

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment:    At well site Outlar #1, a hazard assessment was not conducted to determine the need for personal protective equipment such as, but not limited to, fire retardant clothing, safety glasses, hand protection, mask, chemical gloves and chemical aprons.  The employees were exposed to corrosive chemicals and natural gases where a flash fire occur.
