29 CFR 1926.503(c): The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section: On or about February 24, 2016, an employee was exposed to a fall hazard greater than 6 feet to the ground below, while working from the roof without being retrained to recognize the hazards of falls.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502: On or about July 29, 2016, employees were exposed to a fall hazard greater than 6 feet to the ground level below, while working from a roof without the use of fall protection equipment or an alternative fall protection plan. The Pedro Flores was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1127407, citation number 1, item number 1 and was affirmed as a final order on 3/30/16, with respect to a workplace located at 2806 Winter Gorge, San Antonio, TX. 78259.
