29 CFR 1910.132(d)(1): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall: a. On or before July 29, 2016, where employees sprayed a chemical to inhibit the growth of fungus on lumber that was being stacked, the employer did not assess the hazard of the chemical being used and require the use of personnel protective equipment, thereby exposing the employees to chemical contact hazards.

29 CFR 1910.219(f)(3): Sprockets and chains. All sprocket wheels and chains shall be enclosed unless they are more than seven (7) feet above the floor or platform. Where the drive extends over other machine or working areas, protection against falling shall be provided. This subparagraph does not apply to manually operated sprockets. a. On or before July 29, 2016 where employees worked near the double end trimmer, the drive sprocket and chain were not effectively guarded, thereby exposing employees to an caught-in hazard. b. On or before July 29, 2016 where employees worked on the outside green chain, sprocket and chain on the drive motor and drive shaft were not effectively guarded, thereby exposing employees to an caught-in hazard.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets. a. On or before July 29, 2016 where employees used chemicals such as, but not limited to Sta Bright P, the employees were not trained on the hazards of the chemical, thereby being exposed to contact hazards. S & J Lumber Company was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 905382, citation number 1, item number 6b and was affirmed as a final order on 8/16/2013 with respect to a workplace located at 3667 Garners Ford Road, Thurman, Ohio, 45685.
