29 CFR 1926.403(b)(1)(vii): 1926.403(b)(1)(vii): Safety of equipment was not determined on the basis of the following considerations: Other factors which contribute to the practical safeguarding of employees using or likely to come in contact with the equipment: (a) Jobsite, Basement Electrical Room: On or about July 26, 2016, the employer selected 3/4 inch long self tapping, 5/16's bolts to secure the trough cover. This trough contained energized conductors. This condition created the possibility of the tip of a self tapping bolt to come in contact with the conductors inside its insulation.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a) Jobsite: On or about July 26, 2016, the employer did not train employees in the recognition and avoidance of the potential hazards created by the protrusion of self tapping bolts into the interior space of wireways housing energized conductors.
