OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees On June 27, 2016 located at the facility maintenance shop a John Deere Model # 1070 tractor had the neutral ignition switch and the seat safety switch located under the operators seat modified to be bypassed creating a caught-in-between hazard when the employee was standing on the ground to start the tractor and his right leg was rolled over by the rear tractor tire causing injuries requiring hospitalization. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records

29 CFR 1910.243(e)(1)(ii): All power-driven chains, belts, and gears shall be so positioned or otherwise guarded to prevent the operator's accidental contact therewith, during normal starting, mounting, and operation of the machine. Employees are required to operate the Toro Z Master Rotary Lawn Mower and the Progressive Turf Mower on a daily basis are exposed to caught-in-between hazards posed by the rotating belts located on the on top of the mower deck that are not guarded to prevent accidental contact during operation of the mower.

29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. On 27 June, 2016, the employer was notified that an employee was exposed to a caught-in-between hazard while starting a John Deere Tractor attached to a progressive rotary mower. The employee sustained injuries requiring the employee to be admitted into a hospital for several days and that the employer did not report the employee in-patient hospitalization to OSHA within the twenty-four hours after the work related incident.
