29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure and employee training to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, start up or release of stored energy could occur and cause injury, the machine or equipment would be isolated, and rendered inoperative in accordance with 29 CFR 1910.147(c)(4):    a) Worksite - On August 1, 2016, and at times prior the employer did not have a written lockout/tagout program. Employees perform servicing and maintenance activities on equipment including, but not limited to, a sealing machine which had pneumatic, and electric energy sources.

29 CFR 1910.178(l)(6): The employer did not certify that each operator had been trained and evaluated as required by paragraph (l) of 29 CFR 1910.178.     a) Worksite - On August 1, 2016, and at times prior, the employer failed to certify that each powered industrial truck operator was trained and evaluated. The certification required must include the operators name, the date of the training, and the identity of the person performing the training.

29 CFR 1904.29(a): A log of all Work-Related Injuries and Illnesses (OSHA Form 300), and/or the Summary of Work-Related Injuries and Illnesses, (OSHA Form 300A) and/or the Injury and Illness Incident Report (OSHA Form 301) or equivalent forms were not kept by the establishment:    a) Worksite - on August 1, 2016, and at times prior, the employer did not maintain an OSHA 300 Log of workplace fatalities, injuries, or illness that are work-related.     -Dec 2015, employee lost one workday, and had 10 days light duty following a scalding incident in the hot water area.
