Employees of All Pro Construction were observed nailing plastic insulation on the side of a residential building , using a pneumatic gun, without any eye or face protection. 29 CFR 1926.451(e)(1): Where scaffold platforms were more than 2 feet above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers, stairway-type ladders, ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used for access: (a) On or about July 30, 2016, All Pro Construction did not ensure that portable ladders, hook-on ladders, or other proper means of access was used to reach a scaffold platform. Workers crawled through a window to come down from a pump-jack scaffold, exposing employees to falls in excess of 14 feet. 29 CFR 1926.451(g)(1)(v): Each employee on a walkway located within a scaffold was not protected by a guardrail system (with a minimum 200 pound toprail capacity) installed within 9.5 inches (24.1 cm) of and along at least one side of the walkway: (a) On or about July 30, 2016, All Pro Construction, did not ensure that each employee on a walkway within a scaffold was protected by a guardrail system with a minimum 200 pound toprail capacity. A pump-jack scaffold in use by workers did not have guardrails, exposing employees to falls in excess of 14 feet.
