29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years:    (a) Ontario Mechanical on or about July 25, 2016, at the address of 5066 Lincoln Hwy Crestline, OH: The employer did not ensure an operating employee was provided with refresher training relevant to the operation of a Heli forklift. An evaluation of competency for the operator of the stated forklift was not conducted and documented by the employer in the prior 3 years.

29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks.  (a)  Ontario Mechanical on or about July 25, 2016, at the address of 5066 Lincoln Hwy Crestline, OH: The employer did not ensure an operating employee had adequately secured and stabilized a structural steel load to the supporting forks of vertical mast forklift. During the travel and placement of the steel structure, employees walking/working in the immediate vicinity of this condition were exposed to struck-by hazards.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    (a) Ontario Mechanical on or about July 25, 2016, at the address of 5066 Lincoln Hwy Crestline, OH: The employer did not ensure an employee was protected from potential head injuries while working in the immediate area of elevated forklift loads. The employee was exposed to impact injuries while ground guiding a forklift transporting structural steel overhead.
