29 CFR 1926.304(d): Portable, power-driven circular saw(s) were not equipped with a guard above and below the base plate or shoe: (a) New residential construction, cut bench: On or about August 3, 2016, and at times prior, the employer exposed employees to amputation hazards while cutting cornice boards and Hardie Plank Siding, in that a circular saw was used without the lower guard in place as a shim was used between both guards which prevented the lower guard from retracting automatically after a cut was made.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) New residential construction, Roof: On or about August 3, 2016, and at times prior, the employer exposed employees to fall hazards of 23-feet, 9-inches for the 10/12 pitched roof, in that a fall protection system was not provided to employees installing siding and cornice boards on the roof dormer.
