29 CFR 1910.23(c)(3): Regardless of height, open-sided floors, walkways, platforms, or runways above or adjacent to dangerous equipment, pickling or galvanizing tanks, degreasing units, and similar hazards were not guarded with a standard railing and toe board: a) On or about August 5, 2016, the employer did not provide guardrails on a walkway/platform that was next to Tank 9 containing AR3000 Dispersion in Building 105 Up. The tank was 8.1 feet deep and approximately 6.4 feet wide. b) On or about August 5, 2016, the employer did not provide guardrails on a walkway/platform that was next to Tank 18 containing BW0141 in Building 105 Up. The tank was 8.4 feet deep and approximately 7.8 feet wide. c) On or about August 5, 2016, the employer did not provide guardrails on a walkway/platform that was next to Tank 24 containing SP5000 AC-2 Primer CLA in Building 105 Up. The tank was 7.5 feet deep and approximately 4.5 feet wide.

29 CFR 1910.146(e)(1): Before entry was authorized, the employer did not document the completion of measures required by 29 CFR 1910.146(d)(3) by preparing an entry permit: On or about August 5, 2016, the employer failed to ensure employees prepared an entry permit prior to working inside the following confined spaces: Tank 24 containing SP5000 AC-2 Primer CLA in Building 105 Up Employees are exposed to SP5000 AC-2 Primer CLA Vapors and Acetone Vapors. Both chemicals are classified as a highly flammable liquids. Employee are exposed while performing cleaning of tanks.
