29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  (a) Production - On August 5, 2016, the employer failed to equip the Mori Seiki SL-25 CNC lathe with working interlocks exposing employees to entanglement hazards.   (b) Production - On or about August 5, 2016, the employer failed to guard the unused portion of the Pat Mooney Inc. horizontal band saw to protect the operator from the hazard created by the unused portion of the blade while in operation.  In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase, or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a) Facility Wide - On or about August 5, 2016, the employer did not implement at the workplace a written hazard communication program in accordance with 29 CFR 1910.1200 that describes at least the following:  1) Requirement for labeling of containers or hazardous chemicals:  2) Safety data sheet(s) availability;  3) Training of employees;  4) A complete list of hazardous chemicals known to be in the workplace;  5) Methods to inform employees of the hazards of non-routine tasks; and,  6) Methods to inform other employer(s) of safety data sheets availability; the labeling system and any precautionary measures to protect employees.  The employees were exposed to hazardous chemicals, including, but not limited to Xtreme Cut 251C containing distillates and propylene glycol.     In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  (a) Facility Wide- On or about August 5, 2016, employees working with cutting and grinding fluid were not provided information and training on hazardous chemicals. The employees were exposed to hazardous chemicals, including, but not limited to Xtreme Cut 251C containing distillates and propylene glycol.
