29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: a) At the jobsite (same lot as Mayan's Auto Body Shop): An employee was working on the ground operating a Dewalt miter saw in close proximity to Ingersoll- Rand VR-843 Telescopic Material Handler which was stacked with various sized framing lumber and was not wearing head protection such as a hard hat. The employee was exposed to struck-by hazards from falling objects, as observed on or about August 5, 2016. ABATEMENT CERTIFICATION REQUIRED.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) At the jobsite (same lot as Mayan's Auto Body Shop): Employees were engaged in framing a three-story house that was at least twenty-one (21) feet above the lower level without the use of any fall protection. Employees were exposed to fall hazards as observed on or about August 5, 2016. ABATEMENT CERTIFICATION AND DOCUMENTATION ARE REQUIRED FOR THIS VIOLATION. David Troyer Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 988377, citation number 1, item number 1 and was affirmed as a final order on February 8, 2016, with respect to a workplace located at 111 Millstone Drive, Montoursville, PA 17754.
