29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  FITCH MIDDLE SCHOOL, 61 FORT HILL ROAD, GROTON, CT:  On or about and at times prior to August 8, 2016, the employer had not implemented his Hazard Communication Program.  Employees regularly used various flammable adhesives while performing roofing activities.  The hazardous constituents of the adhesives included, but were not limited to: hydrotreated paraffinic oil, naphtha, polymethylene polyphenyl isocyanates, 4,4'-diphenylmethane diisocyanate (MDI), amine catalyst, heat-reactive phenolic resin, toluene, acetone, tert-butyl acetate, methyl acetate), and dimethyl ether.

FITCH MIDDLE SCHOOL, 61 FORT HILL ROAD, GROTON, CT:  On or about and at times prior to August 8, 2016, the employer's written Hazard Communication Program did not include an inventory of the hazardous chemicals in use on the jobsite. Hazardous constituents of the chemicals in use at the site included, but were not limited to: hydrotreated paraffinic oil, naphtha, polymethylene polyphenyl isocyanates, 4,4'-diphenylmethane diisocyanate (MDI), amine catalyst, heat-reactive phenolic resin, toluene, acetone, tert-butyl acetate, methyl acetate), and dimethyl ether.

FITCH MIDDLE SCHOOL, 61 FORT HILL ROAD, GROTON, CT:  On or about and during periods prior to August 8, 2016, the employer had multiple hazardous chemicals at the work site including, but not limited to, flammable adhesives and a two-part insulation adhesive containing diphenylmethane diisocyanate (MDI).  The employer did not have safety data sheets readily available for employee access.

The employer had not provided the employees with training pertaining to the hazards associated with the chemicals or how to protect themselves from those hazards.  Components of the chemicals in use included, but were not limited to: hydrotreated paraffinic oil, naphtha, polymethylene polyphenyl isocyanates, 4,4'-diphenylmethane diisocyanate (MDI), amine catalyst, heat-reactive phenolic resin, toluene, acetone, tert-butyl acetate, methyl acetate), and dimethyl ether.

29 CFR 1926.150(c)(1)(i): Travel distance from any point of the protected area to the nearest fire extinguisher exceeded 100 feet:    FITCH MIDDLE SCHOOL, 61 FORT HILL ROAD, GROTON, CT:    On or about, or at times prior to August 8, 2016, the employer did not ensure that employees were protected from fire hazards during EPDM roof systems installation.  There were several containers of flammable adhesives in storage on the roof.  The gauges on the two fire extinguishers located on the roof indicated that the extinguishers needed recharging.
