OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to excessive heat. Such exposure(s) may lead to serious and life-threatening heat-related illnesses such as heat stroke or heat exhaustion: (a) In the Production Area, employees were exposed to the hazards of heat stress, heat exhaustion, and heat stroke while performing work activities in environments with heat indexes ranging from 122 degrees Fahrenheit to 131 degrees Fahrenheit.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace: (a) Throughout the establishment, forklift operators were not provided with practical training and an evaluation of the operator's performance to ensure the forklift operators were competent to operate a powered industrial truck safely, exposing employees to struck-by and crushed-by hazards.

29 CFR 1904.39(a)(2): The employer failed to report the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, within (24) twenty-four hours: (a) A production employee was hospitalized after a tote bag containing more than 2,000 pounds of sugar fell on the employee, pinning the employee on top of a forklift's forks. The employee was hospitalized for five (5) consecutive days. The employer failed to report the hospitalization within twenty-four (24) hours.
